These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Customer”) and Boise Boxes (“we,” “our,” or “us”), a business located at 805 S 17th St, Boise, ID 83702. These Terms govern your use of our website at boiseboxes.com (the “Website”) and any products or services you purchase from us.

By accessing our Website, submitting a contact form, requesting a quote, or purchasing products or services from us, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our Website or purchase our products or services.

2.1 Product Descriptions

Boise Boxes sells used and recycled corrugated boxes, gaylord boxes, specialty packaging, and related accessories. All products are used unless explicitly stated otherwise. Product descriptions, including box grades (A through D), sizes, and condition assessments, are provided in good faith based on our inspection process. While we strive for accuracy, minor variations in condition within a given grade are normal and expected for used products.

2.2 Grading System

Our products are graded using our four-tier system (Grade A through Grade D) as described on our Box Grading Guide page. Grades represent our professional assessment of box condition at the time of inspection. While we maintain consistent grading standards, used products inherently vary, and minor condition differences within a grade level are to be expected.

2.3 Availability

Product availability is subject to current inventory levels. Because our inventory consists of used boxes sourced from various suppliers, specific sizes, grades, and quantities may not always be available. We will notify you if any portion of your order cannot be fulfilled and offer alternatives or a refund for unavailable items.

2.4 Services

In addition to product sales, we offer delivery services, box buyback services, recycling pickup services, bulk supply programs, and box refurbishment services. Service availability, pricing, and terms may vary and will be communicated to you at the time of your inquiry or order.

3.1 Pricing

All prices are quoted in U.S. dollars and are subject to change without notice. Prices quoted in response to a specific inquiry are valid for 7 business days unless otherwise stated. Volume discounts and bulk account pricing are available and will be outlined in your specific quote or account agreement.

3.2 Payment Terms

Payment is due upon delivery or pickup unless other arrangements have been made in advance. Approved bulk accounts may be eligible for net-15 or net-30 payment terms. We accept cash, check, and electronic payment methods. Returned checks are subject to a $35 returned check fee.

3.3 Taxes

Prices do not include applicable sales tax unless otherwise stated. Idaho state sales tax will be applied to applicable transactions as required by law. Tax-exempt customers must provide a valid tax exemption certificate prior to purchase.

4.1 Order Confirmation

All orders are subject to confirmation and acceptance by Boise Boxes. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, pricing errors, or suspected fraudulent activity. If we cancel your order, you will receive a full refund for any amounts already paid.

4.2 Delivery

Delivery is available within the Boise metro area as described on our Delivery Services page. Delivery dates and times are estimates and are not guaranteed. We will make reasonable efforts to meet stated delivery timeframes but are not liable for delays caused by traffic, weather, vehicle issues, or other factors beyond our control. Free delivery is offered on orders exceeding $150. Orders below this threshold are subject to a delivery fee.

4.3 Inspection Upon Delivery

You are responsible for inspecting all products upon delivery or pickup. Any visible damage, incorrect quantities, or grade discrepancies must be reported to us within 48 hours of receipt. Failure to report issues within this timeframe may limit your ability to request adjustments.

5.1 Return Policy

Due to the nature of used products, returns are handled on a case-by-case basis. If you receive boxes that do not match the ordered grade or size, contact us within 48 hours and we will arrange a replacement or refund. Boxes must be returned in the same condition in which they were received.

5.2 Refunds

Approved refunds will be processed within 5-10 business days using the original payment method. Delivery fees are non-refundable unless the return is due to our error (wrong grade, wrong size, or damaged products not consistent with the ordered grade).

5.3 Satisfaction Guarantee

We stand behind the quality of our graded products. If you are not satisfied with the quality of boxes received relative to their stated grade, contact us and we will work with you to resolve the issue through replacement, credit, or refund.

Our Box Buyback Program allows businesses to sell used corrugated boxes to Boise Boxes. Buyback prices are determined at our sole discretion based on box size, condition, quantity, and current market rates. Quotes provided for buyback transactions are valid for 7 business days.

Final buyback payment is contingent upon our inspection of boxes at the time of pickup or drop-off. If the actual condition of boxes differs materially from what was described, we reserve the right to adjust the buyback price accordingly. You will be notified of any adjustments before payment is finalized.

ALL PRODUCTS ARE SOLD “AS IS” AND “AS AVAILABLE” BASED ON THEIR STATED GRADE AT THE TIME OF SALE. BOISE BOXES MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that used boxes will be suitable for any specific application beyond general storage and packaging. Customers are responsible for determining whether a particular grade and type of box is appropriate for their intended use. Our grading descriptions and recommended uses are provided as general guidance only and do not constitute a warranty of fitness for any particular purpose.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOISE BOXES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR PRODUCTS OR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCTS OR SERVICES GIVING RISE TO THE CLAIM.

We are not liable for any damage to products stored in or shipped using our boxes. The suitability of any box for a specific use is the sole responsibility of the customer.

9.1 Acceptable Use

You agree to use our Website only for lawful purposes and in accordance with these Terms. You agree not to use our Website in any way that could damage, disable, overburden, or impair it, or interfere with any other party's use of the Website.

9.2 Intellectual Property

All content on our Website, including text, graphics, logos, images, and software, is the property of Boise Boxes or its content providers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our Website without our prior written consent.

9.3 Accuracy of Information

While we strive to provide accurate and up-to-date information on our Website, we do not warrant that all information is complete, accurate, or current. Product descriptions, pricing, availability, and other information may contain errors or become outdated. We reserve the right to correct any errors and update information at any time without notice.

You agree to indemnify, defend, and hold harmless Boise Boxes, its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of our Website or products, your violation of these Terms, or your violation of any rights of a third party.

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or your use of our products or services shall be resolved in the state or federal courts located in Ada County, Idaho, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our Website. The “Last updated” date at the top of this page indicates when the most recent changes were made. Your continued use of our Website or services after changes are posted constitutes your acceptance of the modified Terms.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
